Who is responsible for HIPAA?

A loyalty program at a practice knows who your patients are, which treatments they buy and when they come in. Velarya signs a Business Associate Agreement with every practice, on every plan, before any patient data goes in. Sensitive data is encrypted, and access to it is limited and logged.

What Kangaroo says

Kangaroo’s Terms of Service, last revised January 2022, make the customer responsible for deciding whether its products are suitable under regulations such as HIPAA, and say Kangaroo will not be liable if they are not. We found no Business Associate Agreement on its site or in its help center.

Your practice’s own. On Branded and Connected, we build your app and publish it under your practice’s Apple developer account, so your practice holds the listing if you ever change vendors, and your team never handles a signing key or an upload.

Kangaroo offers a custom branded app from its Elite plan, and its FAQ says Kangaroo submits it to Apple and Google. Apple’s App Store lists at least six merchant-named apps under the developer Mobicept Inc., the company that operates Kangaroo.

There is no setup fee on any plan, and you can keep your EMR. Here is who does what.

  1. Sign the Business Associate Agreement first. We sign it with your practice before any patient data goes into the program.

  2. See your program in a demo, with your practice’s branding in the app.

  3. We set up the program with you, and on Branded and Connected we build your own app and publish it under your Apple developer account.

  4. Keep your EMR and your scheduler, or move booking into the app. The chart stays where it is.
